Terms of Service

Important: DigiLegaci is a document preparation and digital estate planning service. We are not a law firm and do not provide legal advice. By using DigiLegaci, you agree to these Terms of Service in full.

1. Acceptance of Terms

By accessing or using DigiLegaci ("the Platform", "we", "us", "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Platform.

2. Nature of Service

2.1 Document preparation only

DigiLegaci provides tools to help you organise and prepare estate planning documents, including will drafts, wishes, vault storage, and legacy messages. These tools are for informational and organisational purposes only.

2.2 Not legal advice

DigiLegaci is not a law firm and does not provide legal advice. Nothing on the Platform constitutes legal advice, creates a solicitor-client relationship, or should be relied upon as a substitute for professional legal counsel. You should always consult a qualified solicitor, attorney, or notary in your jurisdiction before executing any will or legal document.

2.3 Jurisdiction limitations

Will validity requirements vary significantly by jurisdiction, including witness requirements, signature formalities, minimum age, and capacity requirements. DigiLegaci does not guarantee that any document generated through the Platform will be valid or enforceable in your jurisdiction. It is your sole responsibility to ensure your documents comply with applicable local laws.

3. Eligibility

  • You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use this Platform.
  • You must have the legal capacity to enter into a binding agreement.
  • You must provide accurate, current, and complete information when creating your account.

4. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • Ensuring all information you provide is accurate and up to date.
  • Verifying that any documents generated meet the legal requirements of your jurisdiction.
  • Seeking independent legal advice before signing or executing any document.
  • Keeping your trusted contact information current and informing your contacts of their role.
  • Completing your Life Check-ins on time to keep your account active.

5. Subscription and Billing

Access to certain features requires a paid subscription. Subscriptions are billed monthly in advance. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months.

We reserve the right to change subscription pricing with at least 30 days notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.

6. Life Check and Vault Unlock

The Life Check feature is a periodic confirmation that you are alive and able to access your account. If you fail to complete a Life Check within the grace period, DigiLegaci will initiate the vault unlock process by notifying your designated trusted contacts.

DigiLegaci does not independently verify the death or incapacity of any user. The unlock process relies on confirmation from your designated trusted contacts. DigiLegaci accepts no liability for any loss arising from early, delayed, or erroneous vault unlock.

7. Intellectual Property

All content, branding, software, and materials on the Platform are the property of DigiLegaci Ltd and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

You retain ownership of all content you upload to the Platform, including documents, messages, and vault files. By uploading content, you grant DigiLegaci a limited licence to store and process that content solely for the purpose of delivering the service to you.

8. Limitation of Liability

To the maximum extent permitted by law, DigiLegaci shall not be liable for:

  • Any reliance on documents generated through the Platform without independent legal review.
  • The invalidity or unenforceability of any will or document in any jurisdiction.
  • Loss of data, documents, or access due to technical failure, account deletion, or unauthorised access.
  • Any indirect, consequential, special, or punitive damages arising from your use of the Platform.
  • Any actions taken by trusted contacts in connection with the vault unlock process.

Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the total fees paid by you to DigiLegaci in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account at any time if you breach these Terms, engage in fraudulent activity, or use the Platform in a manner harmful to others. Upon termination, your data will be deleted in accordance with our Privacy Policy.

You may delete your account at any time from your account settings. All personal data will be permanently deleted within 30 days of account deletion.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer in another jurisdiction in which case your local consumer protection laws may apply.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and display a prominent notice within the Platform at least 14 days before the changes take effect. Continued use of the Platform after that date constitutes acceptance of the revised Terms.
